10/24/2023 Police Evidence Room Audit - Vendor Requesting to Waive E&O Insurance

A Member City‘s Police Department issued a RFP for evidence consulting services (property room audits, workload studies, policy analysis and development of property room procedures).

 Evidence Control Systems, Inc. (ECS) is requesting to waive the E&O insurance. ECS said that it is typically for construction projects and this type of work doesn’t have the same type of risks. The insurance agent says it will be an additional cost and the 2019 premium was $2,575. If the City absolutely requires E&O, ECS will include the premium with the cost of the contract.  ECS stated, “Out of the 103 audits we have done 99% of the cities have waived.”

 The City asked for a list of the other 103 agencies and it shows that Burbank, Mountain View and Modesto are listed as prior clients.

The Company’s owner and CEO is a former Burbank Police Lieutenant Joe Latta.

PD has requested proposals from a couple other vendors but is not getting a response.

If Board members have any recommendations for vendors or know of others even if they cannot recommend them, please let us know.

We do not have a vendor for this. I can assure though that if the time comes for one, Professional Liability will be a requirement and will never be waived. Any vendor who balks at adding the coverage to their insurance is a vendor I would advise that the City not contract. Further, the cost of the insurance should be spread out over all of their contractual agreements as the liability and risk are still there whether they insure it or not.
