Good afternoon,

 

A police evidence technician went to a training recently in which a topic/question came up regarding the return of prescription medication.The instructor told attendees that police/staff should not return prescription medication even if the owner's name is on the container. The trainer’s explanation was: how do we know what really is in the container and what if the person goes home and overdoses? Apparently, evidence technicians from a few other agencies mentioned that they don't return prescription medication for that exact reason.

 

Anyone have experience with this, policy that speaks to it, etc.

Good morning team,

Please see the email below from our Modesto Property/Evidence Unit Supervisor:

MPD P&E Unit follows Post LE Evidence & Property Management Guide (4th Edition) where in leaves the determination up to each agencies City Attorney on considerations for returning  Marijuana or prescription medications to owners.  (Guideline 6.2 Methods of Disposal and Classifications of Property)

It is my understanding based on past/current practice that at some point the CAO reviewed Civil Code law CC2080-2080.10 and made the determination that if the officers in the field investigating deem the Prescription RX to be valid and true to the medication markings as well as Marijuana at or under the legal limit to meet the criteria for return to owner they book it in as SAFEKEEING or FOUND versus booking it in as DESTROY. 

 

Upon receiving Safekeeping and Found we store them for the required time frame under law (60 or 90 days)  prior to destroying as abandoned.  If the owners do come to pick up their legal substance, we have them sign the attached waiver prior to releasing the item the officers booked for return to them.  (sorry about the line in the scan image – It looks like I will be cleaning our scanner right after I hit send on this email)
